Welcome to Tab Colorizer, a product of GooberWorks LLC ("we," "us," or "our").
These Terms of Service, Privacy Policy, and Refund Policy (collectively, the "Agreement") govern your use of our browser extensions, websites, and related services ("Services").
By installing, accessing, or using our Services, you agree to this Agreement.
1. Terms of Service
1.1 Eligibility
You must be at least 18 years old (or have parental consent) to use our Services. By using them, you confirm you have the authority to enter into this Agreement.
1.2 Accounts and Licenses
You may be asked to provide an email address to activate a license or receive updates. You agree to provide accurate information and to keep it current.
License keys are personal and may not be shared, sold, or transferred.
1.3 Trial and Paid Plans
We may offer a trial version with limited-time or feature-restricted access.
Paid plans may be one-time or recurring subscriptions, processed securely through Paddle Payments.
Paddle.com acts as the Merchant of Record for all transactions and handles payment processing, tax, and invoicing on our behalf.
All pricing and billing terms are displayed at checkout and may change with notice.
1.4 Automatic Renewal
If you purchase a subscription, it will automatically renew at the end of each term unless you cancel through your Paddle account before renewal.

1.5 Acceptable Use
You agree not to:
- Reverse engineer, copy, or redistribute our software;
- Circumvent licensing or payment systems;
- Use the Services for unlawful purposes.
1.6 Ownership and Intellectual Property
All content, code, logos, and designs within Tab Colorizer are the intellectual property of GooberWorks LLC.
You are granted a limited, revocable, non-exclusive license to use the software for personal or business use in accordance with these Terms.
1.7 Termination
We may suspend or terminate your license at any time if you violate this Agreement. You may also stop using the Services at any time.
1.8 Disclaimer of Warranties
The Services are provided "as is" and "as available" without warranties of any kind, express or implied.
We do not guarantee uninterrupted operation or that the Services will be error-free.
1.9 Limitation of Liability
To the maximum extent permitted by law, GooberWorks LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use or inability to use the Services.
1.10 Governing Law and Disputes
This Agreement is governed by the laws of the State of Ohio, USA, without regard to conflict-of-laws rules.
Any dispute shall be resolved through binding arbitration in Ohio, conducted in English under the rules of the American Arbitration Association.
Either party may bring a qualifying claim in small claims court in lieu of arbitration.
2. Privacy Policy
2.1 Information We Collect
We collect:
- Email address (for licenses, updates, and newsletters)
- Non-personal analytics data (aggregate usage statistics via Google Analytics)
- Purchase information (handled securely by Paddle; we never store your full payment details)
2.2 How We Use Information
- To activate and verify licenses
- To communicate product updates and offers
- To analyze usage trends and improve our Services
- To comply with legal obligations
2.3 Data Sharing
We only share limited data with:
- Paddle Payments (payment processing)
- Google Analytics (anonymous usage data)
We never sell, rent, or trade your personal data.
2.4 Data Retention
We retain data as long as necessary to provide the Services and comply with law. You may request deletion at any time via [email protected].
2.5 Your Rights
If you are in the EU, UK, or California, you have rights to access, correct, delete, or restrict processing of your data.

2.6 Cookies and Analytics
We use cookies and similar technologies to improve performance and understand aggregated usage.
You may disable cookies in your browser settings.
2.7 Security
We use industry-standard encryption and authentication methods to protect your data.
However, no online service can guarantee absolute security.
2.8 Children's Privacy
Our Services are not directed to children under 13. We do not knowingly collect data from minors.

If you are located in the European Union (EU), European Economic Area (EEA), United Kingdom (UK), or Switzerland, the following applies in addition to our general Privacy Policy:

2.9.3 Data Processors and Sub-processors
We may share limited personal data with trusted processors who help us deliver our Services:
- Paddle.com Market Ltd — payment and subscription processing
- Google LLC (Analytics) — aggregated usage analytics
Each processor operates under GDPR-compliant data protection terms.
2.9.4 International Transfers
Because we are based in the United States, your personal data may be transferred and processed outside your home country.
We rely on one or more of the following mechanisms to ensure adequate protection:
- Standard Contractual Clauses (SCCs) approved by the European Commission;
- The UK International Data Transfer Addendum; or
- Other equivalent safeguards under GDPR Article 46.
2.9.5 Your Rights under GDPR
If you are an EU or UK resident, you have the right to:

- Request correction or deletion ("right to be forgotten");
- Object to processing or request restriction;
- Withdraw consent where processing is based on consent;
- Data portability — to receive your data in a structured, machine-readable format.

2.9.6 Supervisory Authority
If you are located in the EU, you may lodge a complaint with your local data protection authority (DPA).

3. Refund Policy
We offer a 14-day refund period on all purchases in accordance with Paddle's refund policy.
We want you to be completely satisfied with your purchase. If you experience any issues with your digital product, please contact us at [email protected] within 14 days of purchase, and we'll be happy to provide a refund or resolve the issue.
All refunds are handled securely by Paddle.com, our payment provider.
4. Changes to This Agreement
We may update these policies periodically. Material changes will be announced via our website or by email. Continued use of our Services after changes take effect means you accept the revised terms.
